These Terms of Use ("Terms") govern your access to and use of the website reo.tf and its subdomains, and the TwoFold game application available on the Roku platform (collectively, the "Services"), operated by the operator of reo.tf ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 13 years old, or the age of majority in your jurisdiction if higher, to use the Services. By using the Services, you represent that you meet this requirement and that you are able to form a binding agreement.
2. License to Use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. The TwoFold application is licensed to you, not sold.
3. Acceptable Use
You agree that you will not:
- use the Services in any way that violates applicable law or regulation;
- copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of any part of the Services, except where such restriction is prohibited by law;
- interfere with, disrupt, or attempt to gain unauthorized access to the Services, our servers, or any related systems or networks;
- use automated means to access, scrape, or overload the Services; or
- use the Services to transmit malware or engage in any harmful, fraudulent, or abusive activity.
4. Intellectual Property
The Services, including the TwoFold application, and all associated content, software, text, graphics, logos, and other materials, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited license granted above, these Terms do not grant you any rights to our intellectual property. "TwoFold" is an original implementation; any similarity in gameplay to other tile-merging puzzle games does not transfer any rights in those other games to you.
5. Third-Party Platforms and Services
The Services rely on third-party platforms, including the Roku platform, and may in the future include third-party advertising through the Roku Advertising Framework. Your use of those platforms is subject to their own terms and policies, which we do not control. We are not responsible for the content, products, or practices of third parties.
6. Advertising and Online Features
We may, now or in the future, display advertising within TwoFold and offer online features such as saved or shared high scores. We may add, modify, suspend, or remove such features at any time. Your use of those features is also subject to our Privacy Policy.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Because the Services are provided free of charge, our total aggregate liability for any claim relating to the Services will not exceed one hundred U.S. dollars (US $100).
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Services or your violation of these Terms or applicable law.
10. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, the licenses granted to you will end. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) will survive.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the state in which we reside, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in the United States.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
